State of NM and Treaty Rights
The New Mexico Acequia Association calls upon the State of New Mexico to adhere to the protections of land and water rights under Article II Section V of the Constitution of the State of New Mexico, enact a reformed process for recognizing water rights protected by the Treaty rather than the existing adjudication process which is divisive, expensive and undermines the social fabric of our communities, ensure that water rights are not expropriated or impaired as a consequence of implementing any law of Congress or as a consequence of implementing any state statute or agreement, and ensure that acequia easements are recognized and protected.
Regulation of Ponds
The New Mexico Acequia Association supports changes in state law that provide for more stringent regulation of surface water impoundments to prevent further impairment of acequia-based water rights and supports local efforts to prevent impairment of acequia-based water rights by upstream impoundments through legal strategies.
State Water Plan
The New Mexico Acequia Association calls on the Interstate Stream Commission to include a section in the State Water Plan reflecting the NMAA Policy Position on the State Water Plan and urges the ISC and Office of the State Engineer to conduct an acequia stakeholder meeting and include acequia concerns in the consensus-building process.
